Terms of Service

These are quite lengthy, but you will be held to them regardless of whether you read them or not.12/19/2022 Addition: NFT and AI
I do not allow use of my past, present, and future works in NFTs or in AI datasets. I will never make any NFTs of my artwork: any NFTs made with my artwork are not authorized by me and will be reported. I completely disallow AI art developers from using my artwork to train image generation artificial intelligence, as this constitutes a violation of my intellectual property rights.PAYMENT & PAYMENT PLANS
As a general rule, from the moment you, the commissioner, contact me, a work in progress image is to be expected within 12 to 24 hours after first contact, and a commission completion is to be expected anywhere within two days to four weeks, unless otherwise specified. Conditions affecting my commission delivery include but are not limited to: heavy school workload, stressful life conditions, a new job, etc. In this case, you, the commissioner, will be given advance warning if I cannot respect the timeframe given in this ToS.
Payment must be made in full upon presentation of the sketch. Unless otherwise arranged, if the full amount is not paid within 12 hours, your commission will be voided and you will be blacklisted from commissioning me again.
In the event that you cannot pay within 12 hours of the presentation of the sketch, PLEASE LET ME KNOW. I will gladly work something out with you, as long as it is reasonable.COPYRIGHT & LEGAL (IMAGE)
I reserve all rights to the image, not to the character depicted therein, including for use as a portfolio piece, a commission example, and promotion on my own social media. Credit will ALWAYS be given in this case.
You may not make any form of profit off of this image. This is considered copyright infringement.
You may not alter or remove my watermark/signature from the image or otherwise claim the image as your own.
You may not edit, remaster, apply filters to, or otherwise modify an image. (In the case of a reference image, if given explicit written permission, you may ask another artist to incorporate it into a fully fleshed out reference sheet. This is the only exception.)
You may use the image for personal use (upload to social media platforms for example) and must provide full credit in the form of a link to my Toyhou.se or DeviantArt profile.
You may not use my artwork to promote hateful speech or actions. This includes but is not limited to, racism, sexism, misogyny, lgbtphobia, transphobia, pedophilia, and zoophilia.
In the event that you somehow lose or corrupt the original file of the art you commissioned from me: please message me! I keep a copy of every original file on hand in case this very situation happens, and I will be happy to provide you with it at no extra charge.COPYRIGHT & LEGAL (CUSTOM DESIGN)
I reserve all rights to the character design, including for use as a portfolio piece, a commission example, and promotion on my own social media. Credit to the current owner will ALWAYS be given in this case.
You may not sell them to publicly blacklisted users. If you know this, and knowingly trade or sell to them, you will also be publicly blacklisted.
You may not make any form of profit off of this design, or use it for commercial use. This is considered copyright infringement. The one exception is if someone commissions you to draw your own character.
You may not alter or remove my watermark/signature from the image or otherwise claim the design as your own.

If you fail to do this, you will be blacklisted.
You may not delete any character designs I have created off of Toyhouse, or otherwise modify the credits. This will also get you blacklisted.
In the event that you somehow lose or corrupt the original file of the custom design you commissioned from me: please message me! I keep a copy of every original file on hand in case this very situation happens, and I will be happy to provide you with it at no extra charge.COPYRIGHT & LEGAL (3D MODELS)
Upon commissioning me for a 3D model, you agree to these terms:
I reserve all rights to the 3D sculpt, not to the character of which the model was made, including for use as a portfolio piece, a commission example, and promotion on my own social media. Credit will ALWAYS be given in this case.
You may not make any form of profit off of this model, or use it for commercial use. This is considered copyright infringement.
You may not significantly alter the model to fit another character’s design or redistribute the model. If you are caught doing this, you will be publicly blacklisted.
You may use your 3D model for VRChat (see 7), personal compositions, referencing, and other, PERSONAL, uses.
You may rig the model yourself in Blender, Maya, or any other program, as I do not provide rigged models, only the basic sculpt.
You may not claim ownership of the 3D model: attribution must always be given in the form of a link to my Toyhouse or DeviantArt. In the case of an upload to Toyhouse, you must credit me in the “Artist” field with my Toyhouse username. DeviantArt, Instagram, Buzzly, or any other links do not constitute proper credit and I will contact you to give you an opportunity to input my Toyhouse username. If you fail to do this, you will be blacklisted.
In the event the model is used in VRChat, you may not allow other users to clone the avatar you made from the model, nor may you use it in a world that permits avatar cloning.
In the event that you somehow lose or corrupt the original file of your model: please message me! I keep a copy of every original model on hand in case this very situation happens, and I will be happy to provide you with it at no extra charge.CHARGEBACKS AND REFUNDS
If you are unsatisfied with your commission, even after presentation of the sketch and opportunities having been given to tweak and modify certain things, I unfortunately cannot offer a full refund, due to the time taken on your commission.These Terms of Service are effective Monday, March 9th, 2022, 8 PM EST.
